Even if they win, is it smart to give the NCAA subpoena power in their case or even let the NCAA revisit the penalties and give them a four year death penalty? I'm not sure that they want to open that can of worms.

But I think the Penn State issue is not, as said before, a football issue or anything to do with football. Other than public perception, I don't think the football program should have been punished. A crime was committed, by a lot of people. The laws of the land take care of crimes against society. Unlike Ohio State, SMU or USC, ad infinitum, there was no NCAA infractions. This lack of institutional control can only apply to maintaining NCAA rules that were established, it cannot continue to be this catch all for the NCAA to be the self appointed vigilante of law enforcement. I think the problem of the NCAA being sued by Penn State, is risky, but I hope they do, and I think there would be a lot of college Presidents out there hoping they do and win...but of course they will with gutlessness stand on the sidelines an say nothing.

To be clear, I would hope the law will punish those that conspired in the crimes at Penn State.

I tend to think it does apply but only because it was a football coach, covered up by other coaches and staff, and because it happened in football. If it happened in the business school and was carried out by a economics professor I don't think it would matter. The fact that it happened in the football stadium by football staff and was covered up by Paterno and the AD I think it makes it fall within the NCAA field of play.

I tend to agree that it is a legal issue. I think the NCAA is coming in from a standpoint that the whole Sandusky cover-up was not to protect Sandusky, but the football program and Paterno's reputation. I think that Penn State will win the lawsuit, I'm just not sure the price of winning will be worth it. By entering into the lawsuit, they give the NCAA the right to subpoena their records, emails, coaches, administrators, and players with the threat of perjury and jail time for people who do not cooporate. That could open them up to the death penalty and the NCAA is vindictive enough to hand it out.

I agree here. I think it's a bad PR move, since they have already admitted guilt of those involved by removing the statue of Paterno. Why do that if you're not admitting that wrong was done.....and if wrong was done, take your medicine and move on, before you make someone, and the public, REALLY angry. As it stands now, I'll never watch another Penn State game for a while (many years), even if they play Georgia. I don't understand why they want to continue to drag this through the public consciousness.

I'm good with them getting rid of the guilty and moving on. I don't have anything against Penn State, as long as no guilty person remains.

I am for getting rid of the NCAA period and makinga new body. One for football and one for the rest of the sports. Good riddance!

I can't say that the NCAA has been a good thing. I think the idea of a rules and inforcement body is good, but the NCAA rules over reach.
